TERMS AND CONDITIONS OF PARTICIPATION AND LIABILITY POLICY

1. General

The Höttinger Gass(i)e Club is a group walk for dogs and their owners. Participation is voluntary and at one’s own risk. By participating, participants agree to these terms and conditions.

2. Responsibility for Humans and Dogs

Each participant is responsible for themselves and their own dog. This applies throughout the entire meeting as well as to the conduct of one's own dog toward other people, dogs, and animals.

Dog owners are required to adequately supervise and securely handle their dog at all times and to ensure that it does not pose any avoidable risks. All applicable legal regulations, in particular leash and muzzle requirements, must be observed.

3. Behavior During the Walk

Participation is at one's own risk. Every person is responsible for accurately assessing their own capabilities, physical condition, as well as the behavior and compatibility of their own dog.

Participants agree to be considerate of other people and dogs, maintain sufficient distance, and follow the instructions of the organizer insofar as they serve safety and an orderly progression.

The organizer may exclude participants or dogs from further participation in the event of dangerous situations, conspicuous behavior, or a lack of consideration.

4. Liability and Disclaimer

The organizer assumes no responsibility for accidents, injuries, illnesses, the escape or loss of a dog, as well as for property damage and financial loss arising in connection with participation in the Höttinger Gass(i)e Club, to the extent that a disclaimer is legally permissible.

This applies in particular to incidents during the group walk, at the meeting point, and during the individual journey to and from the meeting point.

Each participant bears responsibility for their own safety and for their own dog. The organizer provides no guarantee regarding the compatibility of the participating dogs with one another or for a hazard-free walk.

The liability of the organizer for damages for which they are mandatory liable under legal provisions, in particular for personal injury as well as intentional or legally non-excludable culpable conduct, remains unaffected.

5. Damages Caused by Dogs

For damages caused by one's own dog, the respective responsible dog owner is fundamentally liable in accordance with legal provisions. This concerns in particular injuries to other people or dogs as well as property damage.

Participation in the Höttinger Gass(i)e Club does not release dog owners from their legal duties of supervision and care.

6. Independent Travel

Travel to and from the event is undertaken independently and at one's own risk. The organizer does not organize or monitor the individual journey of participants to or from the event and assumes no responsibility for this, to the extent legally permissible.

7. Consent

By participating in the Höttinger Gass(i)e Club, participants confirm that they have read and acknowledged these terms and conditions. They commit to observing safety rules and acting on their own responsibility.

8. Photo and Video Recordings and Use for Advertising Purposes

Photo and video recordings may be made during the Höttinger Gass(i)e Club. These recordings may be used and published by paupau – the shop for their own advertising and communication purposes. This includes, in particular, use on the website, in social media (e.g., Instagram), in promotional materials, as well as in other communication channels of paupau – the shop.

The use of the recordings is provided free of charge. No fee or other compensation will be paid for the creation, use, editing, or publication of the recordings.

The publication of recordings in which participating individuals are recognizable only occurs on the basis of corresponding voluntary consent. This consent may be revoked at any time with effect for the future. The lawfulness of processing carried out prior to revocation remains unaffected.

Individuals who do not wish to have photo or video recordings taken of them may communicate this before the start or at any time during the meeting. Such requests will be respected.

Consent to the use of photo and video recordings is voluntary and is not a prerequisite for participation in the Höttinger Gass(i)e Club.
